Guarantee Policy

1. GENERAL CONDITIONS

1.1. These warranty terms and conditions cover the entire range of products manufactured and distributed by IMPLANT PROTESIS DENTAL 2004 S.L. (hereinafter referred to as "IPD").

1.2. The guarantee described above is provided exclusively to IPD customers who have directly purchased products manufactured by IPD, and must have the corresponding purchase invoice for the product purchased.

1.3. For the aforementioned purposes, only registered dental clinicians, technicians or dental technicians and/or professional companies constituted by at least one of the aforementioned registered dental professionals shall be considered "Clients" of IPD and, therefore, beneficiaries of the guarantee. Therefore, the execution of this guarantee shall not be enforceable by third parties other than the aforementioned.

1.4. Under this warranty, IPD will replace products for manufacturing defects.

1.5. From the date of delivery of the products, the Customer assumes all risks and liabilities arising from the use of the products purchased, whether they are used separately or in conjunction with other products.

2. SCOPE OF WARRANTY FOR IPD PRODUCTS

2.1. IPD offers a lifetime warranty on all its products from the date they are placed on the market.

2.2. For this purpose, the Client must demonstrate the following requirements:

i. Not having combined IPD products with the products of other compatible component manufacturers.
ii. Properly justify that the products have been properly used and maintained following IPD's product use instructions in accordance with commonly accepted practices in dentistry, thus excluding any misuse, abuse, neglect, tampering or storage contrary to these.
iii. Return the defective product correctly sterilised and bagged.
iv. Provide the fully completed warranty form as well as the original invoice for the purchase of the IPD product.
v. Be up to date with payments due to IPD at the time the claim is submitted.
vi. Have respected the osseointegration and healing period.

2.3. The following shall not be deemed to be included, and therefore not covered, in this IPD guarantee programme:

  • Custom-made or specially modified products.
  • Abutments once transformed as part of the dental prosthesis.
  • When the failure results from an accident, trauma or damage caused by a third party.
  • When the failure of the product is due to normal wear and tear.
  • When all procedures using the damaged products were not performed in accordance with the instructions for use of the IPD products, nor in accordance with commonly accepted practices in dentistry.• Use of the product with accessories, add-ons and other products of a type, condition or standard not established by IPD.
  • When products have been modified to alter their functions or capabilities without prior authorisation from IPD.

3. SCOPE OF WARRANTY FOR IPD PRODUCTS IN COMBINATION WITH IMPLANTS FROM OTHER MANUFACTURERS

3.1. IPD shall bear the cost corresponding to the value of dental implants from third party manufacturers that are damaged as a result of the use of our products, provided that the following requirements have been met:

i. Not having combined IPD products with products from other manufacturers of compatible components that are not expressly validated by IPD.
ii. Properly justify that the products have been properly used and maintained in accordance with the instructions for use of IPD products as well as commonly accepted practices in dentistry, thus excluding any misuse, abuse, neglect, tampering or storage contrary to these.
iii. Return the defective product (implant and related components) properly sterilised and bagged.
iv. Provide the written communication from the implant manufacturer refusing the execution of the warranty on the implant due to the use of the IPD product. vii. Provide the fully completed warranty form as well as the original invoice for the purchase of the IPD product and the corresponding implant from another manufacturer validated by IPD.
v. Be up to date with payments due to IPD at the time the claim is submitted.
vi. Have respected the osseointegration and healing period.

3.2. IPD offers a warranty subject to the same warranty period as that offered by the manufacturer of the implant used. 3.3. Shall not be deemed to be included, and therefore not covered, in this IPD guarantee programme:

  • In the case of immediately loaded restorative treatments.
  • Cases in which concomitant peri-implant disease has occurred.
  • When the product failure results from an accident, trauma or damage caused by a third party.
  • When there are defects in the material or manufacture of the third party implant.
  • When there are contraindications of the patient or causes related to alcoholism, smoking, drug use or diabetes.
  • Custom-made or specially modified products.
  • When the failure of the product is due to normal wear and tear.
  • When all procedures where the damaged products were used were not performed according to the instructions for use of IPD products, nor according to commonly accepted practices in dentistry.
  • Use of the product with accessories, add-ons and other products of a type, condition or standards not established and/or authorised by IPD.
  • When products have been modified to alter their functions or capabilities without prior authorisation from IPD.

4. GENERAL LIMITATIONS OF THIS WARRANTY

4.1. IPD on behalf of itself, its representatives and third party manufacturers or distributors of the products rejects:

a) Any other warranty, covenant or other undertaking, express or implied, oral or written, with respect to the products (without limitation) including implied warranties of merchantability, durability or fitness for particular uses or purposes.
b) Any liability in respect of damage caused directly, indirectly, resulting from or consequential to the design, composition, condition, use or development of the dental prosthesis in which the products are integrated.

5. COMPLAINT PROCEDURE

5.1. To receive the benefits under these warranty terms and conditions, the Customer must submit a duly completed and signed claim form of guarantee (FLO1c) by email to the address customerservice@ipd2004.com.

5.2. The defective product must be sent by the Client, once sterilised and bagged, to IPD offices located at Rosa dels Vents 9 15, 08338 Premià de Dalt (Barcelona), together with the original documentation necessary to analyse whether it is included in the present guarantee. The expenses derived from this procedure shall be borne by the Client.

5.3. Together with the request for return, the Client must certify and accompany the documentation that proves the fulfilment of all the procedures involved in the product and that they have been carried out according to the instructions of IPD, as well as following the commonly accepted practices in dentistry.

5.4. The cost of shipping the replacement product shall in all cases be borne by IPD.

5.5. The claim must be submitted within 30 days after detection of the defect or non-conformity of the product.

5.6. IPD shall carry out the management and internal analysis of the cases within a maximum period of 30 working days, counting from the receipt of all the documentation and information required for this purpose by IPD.

5.7. Once the maximum period of 30 days has elapsed, IPD will issue a report on the open incident and, on the basis of the analysis carried out, will inform the interested party whether or not the requested guarantee has been accepted.

6. MODIFICATION OR SUSPENSION OF THE GUARANTEE

6.1. IPD reserves the right to modify or terminate this warranty program at any time without notice. Changes or termination of the warranty will not affect products subject to the warranty and reported to IPD prior to the date of the change or termination.

6.2. The version in Spanish of these warranty terms and conditions shall prevail over any translation in case there is any conflict or discrepancy of interpretation.
