Guarantee Policy

1. GENERAL CONDITIONS
1.1. These terms and conditions of guarantee cover the entire range of products manufactured and distributed by IMPLANT PROTESIS DENTAL 2004 S.L. (hereinafter, ‘IPD’).
1.2. The guarantee described is provided exclusively to IPD clients who have directly purchased products manufactured by IPD, and must have the corresponding purchase invoice for the product purchased.
1.3. For the aforementioned purposes, only registered dental clinicians, technicians or dental technicians and/or professional companies formed by at least one of the aforementioned registered dental professionals shall be considered ‘Clients’ of IPD and, therefore, beneficiaries of the guarantee. Therefore, the execution of this guarantee shall not be enforceable by third parties other than the aforementioned.
1.4. Under this guarantee, IPD shall replace products that present manufacturing defects.
1.5. From the date of delivery of the products, the Customer assumes all risks and responsibilities arising from the use of the products purchased, whether they are used separately or in conjunction with other products.
2. SCOPE OF THE WARRANTY FOR IPD PRODUCTS
2.1. IPD offers a lifetime warranty on all its products from the date of their commercialisation.
2.2. In order to do so, the Customer must demonstrate the following requirements:
I. Not having combined IPD products with the products of other manufacturers of compatible components.
II. Proper use and maintenance of the products in accordance with the instructions for use of the IPD product in accordance with commonly accepted practices in dentistry, thus excluding any misuse, abuse, negligence, manipulation or storage contrary to these.
III. Return the defective product correctly sterilised and bagged.
IV. To provide the fully completed warranty form as well as the original invoice for the purchase of the IPD product.
V. To be up to date with the payments due to IPD at the time the claim is submitted.
VI. The osseointegration and healing period has been observed.
2.3. Shall not be considered as included and therefore not covered by this IPD warranty programme:
- Custom-made or specially modified products.
- Abutments once they have been transformed as part of the dental prosthesis.
- When the failure results from an accident, trauma or damage caused by a third party.
- When the product failure is due to normal wear and tear.
- When all procedures using the damaged products have not been carried out in accordance with the instructions for use of IPD products, nor in accordance with commonly accepted practices in dentistry.
- Use of the product with accessories, attachments and other products of a type, condition or standard not established by IPD.
- When the products have been modified to alter their functions or capabilities without prior authorization from IPD.
3. SCOPE OF WARRANTY FOR IPD PRODUCTS COMBINED WITH OTHER MANUFACTURERS' IMPLANTS
3.1. IPD will assume the cost corresponding to the value of dental implants from third party manufacturers that are damaged as a result of the use of our products, provided that the following requirements have been met:
I. Not to have combined IPD products with products from other manufacturers of compatible components that are not expressly validated by IPD.
II. Properly justify that the products have been properly used and maintained in accordance with the instructions for use of IPD products as well as the commonly accepted practices in dentistry, thus excluding any misuse, abuse, negligence, manipulation or storage contrary to these.
III. Return the defective product (implant and the corresponding components) correctly sterilised and bagged.
IV. Provide the written communication from the implant manufacturer refusing the execution of the guarantee on the implant due to the use of the IPD product.
VII. Provide the fully completed warranty form as well as the original invoice for the purchase of the IPD product and the corresponding implant from another manufacturer validated by IPD.
V. Be current in payments due to IPD at the time the claim is submitted.
VI. The osseointegration and healing period has been observed.
3.2. IPD offers a warranty subject to the same warranty period as that offered by the manufacturer of the implant used.

3.3. Exclusions from IPD Warranty Program:
The following cases will not be considered included and therefore are not covered under this IPD warranty program:

  • When dealing with immediate load restorative treatments.
  • Cases involving concomitant peri-implant disease.
  • When product failure results from an accident, trauma, or damage caused by third parties.
  • When defects exist in the material or manufacturing of the third-party implant.
  • When there are contraindications related to the patient or causes such as alcoholism, smoking, drug use, or diabetes.
  • Custom-made or specially modified products.
  • When product failure is due to normal wear and tear.
  • When all procedures using the damaged products were not performed following IPD product instructions for use or commonly accepted dental practices.
  • Use of the product with accessories, components, or other products of a type, condition, or standards not specified and/or authorized by IPD.
  • When products have been modified to alter their functions or capabilities without prior authorization from IPD.

4. GENERAL LIMITATIONS OF THIS WARRANTY
4.1. On its own behalf, and on behalf of its representatives and third-party manufacturers or distributors of the products, IPD disclaims:
a) Any other warranties, agreements, or commitments, whether express or implied, oral or written, concerning the products, including (but not limited to) implied warranties of merchantability, durability, or fitness for particular uses or purposes.
b) Any liability for direct, indirect, consequential, or resultant damage caused by the design, composition, condition, use, or development of the dental prosthesis in which the products are integrated.

5. CLAIM PROCEDURE
5.1. To receive the benefits under these warranty terms and conditions, the Customer must request the warranty form from Customer Service at the email: customerservice@ipd2004.com, within 30 days of detecting the defect or non-conformity of the product.
5.2. Once the warranty request is received, Customer Service will provide the Customer with the warranty form (FLO1c), indicating the assigned claim number.
5.3. The customer must:
a) Submit the warranty form (FLO1c), duly completed and signed, as well as the documentation requested in the form, via email to customerservice@ipd2004.com.
b) Send the defective product, sterilized and packaged, along with the necessary original documentation, to IPD's offices at Calle Rosa dels Vents 9-15, 08338 Premià de Dalt (Barcelona). The costs incurred in this process will be borne by the Customer.
c) Along with the return request, certify and provide documentation that proves all procedures related to the product were performed in accordance with IPD instructions and commonly accepted dental practices.

5.4. IPD will only proceed with the management and internal analysis of the cases once the defective product and all required documentation and information are received.
5.5. Within a maximum period of 30 days from the complete receipt of the defective product and all required documentation and information, IPD will issue a report on the case and communicate the acceptance or rejection of the warranty claim based on the analysis performed.
If additional information is requested during this period, the timeline will be paused and will resume once the requested additional documentation is provided.
5.6. The shipping cost for the replacement product will, in all cases, be borne by IPD.

6. MODIFICATION OR SUSPENSION OF THE WARRANTY
6.1. IPD reserves the right to modify or terminate this warranty program at any time without prior notice. Changes or termination of the warranty will not affect products already covered by the warranty and reported to IPD prior to the date of the change or termination.
6.2. The Spanish version of these warranty terms and conditions will prevail over any translation in case of conflict or discrepancy in interpretation.
